Register how the product looks, not just how it works.

An industrial design protects the shape, configuration, pattern or ornamentation applied to an article — the features judged solely by the eye, distinct from how the article functions. Design registration is administered by the Design Wing of the Indian Patent Office under the Designs Act, 2000.

What Qualifies

New, original, and judged solely by the eye

A design must be new or original and must not have been disclosed to the public, anywhere, before the filing date — through prior publication, prior use, or any other way, in India or elsewhere.

Protection covers only visual, ornamental features. Any feature dictated purely by the article's function or mechanical operation falls outside the Designs Act and, where relevant, is more appropriately protected by a patent.

Before You File

  • Keep the design confidential until the application is filed — public disclosure can defeat novelty
  • Prepare clear representation sheets showing every view of the article the registration should cover
  • Confirm the article's class under the Locarno Classification used by the Design Wing

How a Design Proceeds

From filing to registration

Filing

Form-1 is filed with representation sheets and the relevant Locarno class for the article.

Examination

An examiner reviews the application for novelty and compliance with formal requirements.

Objection / Response

Any objections raised are answered within the statutory period, by argument or amended representation.

Registration

Once accepted, the design is registered and published in the Patent Office Journal.

Renewal

Protection runs 10 years from registration, extendable once by 5 more years.

Can I register a design and a trademark for the same product?

Yes — a product's shape can potentially be registered as a design while its name or logo is separately protected as a trademark; the two rights serve different purposes.

Does design registration cover how the product works?

No. Functional or mechanical features are excluded — only visual appearance judged by the eye is protected.

What if my design combines two existing designs?

A combination can be registrable if it produces a genuinely new visual effect, but simply pairing two known designs without a novel result is unlikely to succeed.

How long do I have to register after launching the product?

None — prior publication or use anywhere defeats novelty, so registration should be filed before the design is disclosed publicly, including in marketing or a product launch.
